These are the rules for using YapApply. We've kept them short and plain. Please read them with our privacy policy, which explains what happens to your information.
The short version
You need to be 16 or older, and your account is just for you.
What you put in, and what YapApply writes for you, is yours.
YapApply writes from your own words, but AI can get things wrong. Read everything before you send it: what goes out is up to you.
YapApply is free during early access. We'll tell you before anything costs money, and you'll never be charged without saying yes.
You can download everything, delete everything and leave, any time.
These terms follow Ontario law, and nothing in them takes away your rights under consumer protection law.
1. About these terms
These terms are an agreement between you and Ken Milstone-Turner, who runs YapApply in Toronto, Ontario, Canada ("YapApply", "we" or "us"). They cover the website at yapapply.com, the app at app.yapapply.com, and anything else we offer under the YapApply name.
You agree to them when you create an account or use the app. If you only visit yapapply.com or join the early-access list, sections 7, 8, 12, 13 and 15 apply to you, and our privacy policy explains what we do with your email address.
2. Who can use YapApply
You must be 16 or older.
Your account is for you alone, for your own job search. Don't share it, or sign in as someone else. If you help someone else with their applications, they should have their own account.
Keep your password to yourself. If you think someone else has got into your account, tell us at hello@yapapply.com right away.
Use a real email address that you can read. We use it to sign you in and to reach you.
During early access, YapApply is invite-only. We let people in a few at a time, and decide who gets in and when.
3. Early access and price
YapApply is free during early access.
It's still being built. Features will change, some may go away, and you may hit bugs or times when it's down. Keep your own copies of anything important: download your documents, or a backup of everything from Settings.
If we start charging, we'll tell you clearly before then. You'll never be charged unless you choose a paid plan and say yes, and stopping a paid plan will be as easy as starting one.
We may set fair limits on use, like how many documents can be written in a day, to keep YapApply running well for everyone.
4. Your content
"Your content" means everything you put into YapApply (your stories, uploads, jobs and answers) and everything YapApply writes for you (resumes, cover letters, LinkedIn text and answers).
It's yours. We don't claim to own any of it, and you can use what YapApply writes for you however you like.
You let us handle it to run YapApply. You give us permission to store, copy, process and show your content, and to send it to the companies listed in our privacy policy, only to run YapApply for you, keep it secure and fix problems. This permission ends when you delete your content, apart from the short time copies take to age out, as the privacy policy explains.
No training. We don't use your content to train AI models, and we don't share it except as the privacy policy says.
You have the right to share it. You confirm you're allowed to put in what you add, including files you upload and anything about other people. That includes keeping to any non-disclosure agreement or confidentiality duty you have to a current or past employer, client, partner or anyone else you've worked with. Leave out what you've promised to keep private, or describe it in general terms.
Similar wording happens. AI writing can repeat common phrases, so other people may get lines that look like yours. We can't promise every line is unique to you.
5. Honest applications
YapApply is built to tell your real story well, never to make one up.
It writes from what you tell it and checks each line against your own stories. You're responsible for reading everything it writes, and for making sure it's true and accurate before you send it.
Don't use YapApply to invent jobs, titles, dates, degrees, credentials, numbers or references, or to apply as someone else.
You decide what to send, and to whom. YapApply never submits an application or sends a message for you.
6. What AI can and can't do
AI can be wrong, leave things out or misread a job posting. Read everything before you rely on it.
YapApply can't promise interviews, offers or any other result. Fit checks and suggestions are opinions to help you decide, not guarantees.
Nothing in YapApply is legal, immigration, financial or other professional advice. For those, talk to a qualified person.
7. Using YapApply fairly
Please don't:
break the law, or use YapApply to harm, harass, deceive or discriminate against anyone;
upload anything you don't have the right to share, including other people's private information, or anything that infringes someone else's rights;
try to get into anyone else's account or information, or into parts of YapApply you aren't meant to reach;
attack, overload or interfere with YapApply, or get around its limits or security;
copy or collect YapApply's content or data with bots or scripts, or take the app apart to see how it works, except where the law allows it;
try to trick the AI into ignoring its instructions, revealing them, or writing something harmful;
resell YapApply, or use it to build a competing product.
If you find a security problem, please tell us at hello@yapapply.com rather than testing it further.
8. What belongs to us
YapApply's app, website, design, name, logo, coach character and the instructions it gives the AI belong to us (artwork credited to others belongs to them). You may use YapApply for your own job search under these terms. That's a personal permission: you can't pass it on, and these terms don't give you any other rights in what's ours.
9. Other services
YapApply works alongside services run by others, like the job sites you link to, or Google Docs if you choose to save a document there. Their own terms and privacy policies apply to what you do with them, and we aren't responsible for them.
10. Ending your account
You can stop using YapApply any time, and delete everything in Settings, under Your data. That ends this agreement.
We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other people or YapApply. Where it's reasonable and safe, we'll tell you first and give you a chance to download your information.
If you don't sign in for 24 months, we delete your account, and we'll email you 30 days before (see the privacy policy).
If we ever shut YapApply down, we'll give you at least 30 days' notice so you can download your information.
Sections 4, 11, 12, 13, 15 and 16 keep applying after your account ends, where they still matter.
11. Your ideas
If you send us ideas or feedback about YapApply, we may use them without owing you anything. This covers suggestions about YapApply itself, not your content, which stays yours.
12. No promises beyond these terms
We work hard to keep YapApply useful, safe and available, but we provide it "as is" and "as available". As far as the law allows, we make no promises beyond the ones in these terms and our privacy policy, including that YapApply will always be available, will be free of errors, or will suit your purpose.
Nothing in these terms takes away rights you have under consumer protection laws that can't be waived, including Ontario's Consumer Protection Act, 2002. Where those laws give you more, they win.
13. Limits on our liability
As far as the law allows:
we aren't responsible for losses that weren't reasonably foreseeable, or for indirect losses, like a missed job, interview or income;
our total liability to you for all claims about YapApply is limited to the greater of CA$100 or what you paid us in the 12 months before the claim.
These limits don't apply where the law doesn't let us limit our liability, including for fraud, gross negligence or wilful misconduct, or under consumer protection and privacy laws.
14. Changes to these terms
We may update these terms as YapApply grows. For a change that matters, we'll tell you by email or in the app at least 30 days before it takes effect, and say what's changing. If you don't agree, you can delete your account before then. If you keep using YapApply after the change takes effect, the new terms apply.
Small fixes, like typos or clearer wording that doesn't change what the terms mean, take effect when we post them. We'll never use a change to these terms to start charging you without your yes.
15. Ontario law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
If there's a problem, please email us first at hello@yapapply.com and we'll try to sort it out together. If we can't, either of us can take it to the courts of Ontario. If you live somewhere else, you can also use the courts and the consumer protection laws where you live.
Nothing in these terms makes you go to arbitration, or stops you from taking part in a class action.
16. The rest of the legal bits
These terms and our privacy policy are the whole agreement between you and us about YapApply.
If part of these terms can't be enforced, the rest still applies.
If we don't enforce a term straight away, we haven't given it up.
You can't transfer your account or these terms to someone else. We may transfer them to whoever takes over running YapApply, like a company set up to run it. We'll tell you before that happens, and your rights under these terms won't shrink because of it.
